Trade In Program Terms & Conditions
Introduction
1.1 The Backmarket Trade-In Program is operated by Renewable Mobile AU Pty Ltd (“RMAU”). These Terms govern your use of our Program and Portal.
1.2 Please review these Terms carefully before using our Portal. Accessing or using the Portal constitutes your agreement to these Terms. If you do not agree, you must cease use immediately.
1.3 For any questions about these Terms or the Program, please use the contact information provided on our Portal.
Important Notices
1.4 You must back up and factory reset your Device prior to sending it to us. We accept no liability for any data loss.
1.5 Our maximum liability is limited to the estimated Trade-In Value of your Device.
PART A: PROGRAM TERMS
- Eligibility for the Program
2.1 To participate, you must: (a) be: (i) an Australian resident, located in Australia, and shipping from within Australia; (ii) aged 18 years or older; (iii) engaging in the Program personally and not for commercial purposes.
(b) own a Device that: (i) was purchased in Australia; (ii) is not subject to any Australian recall; (iii) you own outright and can legally sell; (iv) is not reported lost or stolen and is not block listed; and (v) meets any additional criteria posted on our Portal.
(c) comply with these Terms.
- Submitting a Valuation Request
3.1 Submit a Valuation Request via the Portal.
3.2 Provide: (a) Device details (manufacturer, model, condition); (b) whether you will include a charger (for laptops and watches).
3.3 All information must be accurate, current, and not misleading.
- Assessment of Trade-In Value
4.1 We will estimate the Trade-In Value (inclusive of GST) based on your Valuation Request.
4.2 You may accept the Trade-In Value by completing the steps outlined on the Portal, including: (a) confirming eligibility; (b) submitting identity verification documentation; (c) confirming relevant payment account details for your Device payout.
4.3 Upon acceptance, we will make a payment within 1 business day to your nominated payment method.
4.4 We may impose caps on Trade-In Values.
4.5 We reserve the right to decline or cancel Trade-In Transactions prior to Device receipt.
- Sending Your Device
5.1 Devices must be sent in accordance with the delivery instructions provided.
5.2 You must: (a) ensure the Device matches the original valuation information; (b) ensure it arrives by the Delivery Deadline.
5.3 You bear the risk of loss or damage during shipping.
5.4 Additionally, you are responsible for: (a) proper packaging; (b) insuring the shipment; (c) performing a factory reset and removing data/SIMs; (d) backing up your data.
5.5 We may factory reset the Device upon receipt if you have not done so.
- Assessment Upon Delivery
6.1 Upon receipt, we will verify compliance with Acceptance Criteria.
6.2 If the Device fails assessment, we may: (a) offer a revised Trade-In Value; (b) return the Device.
6.3 If you do not respond to our revised offer emails within 21 days we reserve the right to accept the revised offer on your behalf and proceed to payment.
6.4 If the Device is returned, a fee may be charged for packaging/postage.
- Non-Compliance
7.1 If you breach any Terms, including late delivery or sending an incorrect Device, we may: (a) request correction; (b) revise the Trade-In Value.
7.2 We may suspend your access to the Program for breaches.
7.3 We may cancel Trade-In Transactions involving commercial volumes.
- Transfer of Ownership
8.1 Ownership passes: (a) when we confirm your Device meets Acceptance Criteria; or (b) if you accept a revised offer.
8.2 Any SIM, memory card, or residual data will also transfer to us.
8.3 Discovery of non-compliance after transfer may result in charges being applied to your nominated payment card.
- Additional Terms
9.1 Additional terms may be notified on the Portal.
PART B: PORTAL TERMS
- Using the Portal
10.1 Our Portal is intended for use within Australia.
10.2 Intellectual property rights belong to us or our licensors.
10.3 You must not:
- Use the Portal unlawfully;
- Copy or modify Portal content without permission;
- Interfere with Portal operations.
- Security
11.1 We use reasonable safeguards but cannot guarantee complete security.
11.2 You are responsible for protecting your own systems.
PART C: GENERAL TERMS
- Privacy
12.1 We handle your personal information in accordance with our Privacy Policy and Australia’s Privacy Act 1988 (Cth).
- Updates
13.1 We may update these Terms at any time.
13.2 We may change or cancel the Program without notice.
- Liability
14.1 All warranties are excluded to the extent permitted by law.
14.2 Liability is limited to the Trade-In Value.
14.3 Backmarket disclaims all liability related to the Program.
- General
15.1 You cannot assign your rights; we can transfer ours.
15.2 These Terms are governed by the laws of Australia and parties submit to the courts of Australia.
